New Jersey Real Estate Transfers

All new resale and rental properties with private wells for drinking water must have drinking water testing for primary and secondary contaminants upon the sale or lease of any real estate property. The Private Well Testing Act (PWTA) mandates that the closing of Title may not take place until buyer and seller have received a copy of the well water test results.

The regulations pertain to only “Raw” or “Untreated” well water. In addition, your Local or County Health Departments may also require “Treated” or “Conditioned” water analysis if a water conditioner is present, or if there is a need to correct any parameters that fail the raw water tests.

PWTA New Jersey Well Testing – How it Works

  • Only a laboratory representative from a NJDEP-Certified lab may sample the well water.
  • Water Test Results are completed within 5-to-7 working days.
  • Water Test Reports are e-mailed and/or mailed to Local Health Departments.
  • Water Test Results are electronically transmitted to the NJDEP.
  • The Water Analysis Certification is e-mailed and/or mailed to your home or office.
